江蘇省治理車輛超限(xian)超載聯合執法實(shi)施方(fang)案
為貫(guan)徹中(zhong)央財經領導小組第十六次會議精神(shen),落實(shi)《國務院辦(ban)公(gong)(gong)廳關于進一步推進物流降本(ben)增效促進實(shi)體經濟發(fa)(fa)展的(de)意(yi)見》(國辦(ban)發(fa)(fa)〔2017〕73號)和《交通(tong)運輸部公(gong)(gong)安(an)部關于治(zhi)理車輛超(chao)限超(chao)載聯(lian)合執(zhi)法常態(tai)化制(zhi)度(du)化工(gong)作(zuo)的(de)實(shi)施意(yi)見(試行)》(交公(gong)(gong)路(lu)發(fa)(fa)〔2017〕173號,以下簡稱聯(lian)合執(zhi)法實(shi)施意(yi)見)工(gong)作(zuo)要(yao)求,進一步規范公(gong)(gong)路(lu)治(zhi)超(chao)執(zhi)法行為,全面推進公(gong)(gong)路(lu)治(zhi)超(chao)聯(lian)合執(zhi)法常態(tai)化制(zhi)度(du)化規范化,制(zhi)定(ding)如下實(shi)施方案。
一、指導思(si)想
全面貫徹(che)黨的(de)十九(jiu)大精神,以(yi)習近平新時(shi)代中國(guo)特(te)色社會(hui)主義思想(xiang)為指導,認真落實(shi)“交通強(qiang)國(guo)”重大決策部署(shu),圍繞建(jian)設(she)“強(qiang)富美高”新江(jiang)蘇和(he)“交通強(qiang)省”總(zong)體(ti)要求,以(yi)服(fu)務(wu)交通運輸(shu)發(fa)展、維護人民(min)群眾合(he)法(fa)權益為目標,促進(jin)嚴格(ge)規范公正文明(ming)執法(fa),杜絕(jue)多(duo)頭(tou)執法(fa)和(he)重復罰款,進(jin)一(yi)(yi)步促進(jin)物流業降本增效,進(jin)一(yi)(yi)步優化道路(lu)(lu)運輸(shu)與(yu)物流營(ying)商環(huan)境,進(jin)一(yi)(yi)步保護公路(lu)(lu)和(he)橋梁基礎設(she)施安全,進(jin)一(yi)(yi)步消除道路(lu)(lu)交通安全隱患(huan),努力構建(jian)“體(ti)系強(qiang)”、“功能強(qiang)”、“服(fu)務(wu)強(qiang)”、“科技強(qiang)”的(de)公路(lu)(lu)超限超載治理(li)工(gong)作(zuo)體(ti)系。
二、工作(zuo)目標(biao)
治理車輛超(chao)(chao)限超(chao)(chao)載聯合執(zhi)法工作呈常態化(hua)、制度化(hua)、規范化(hua),到2020年實現以下工作目標:
1.高速(su)公(gong)(gong)路和普通國省(sheng)干線公(gong)(gong)路省(sheng)際入口(kou)、過(guo)江通道(dao)和主要節點公(gong)(gong)路超限檢測站點100%覆蓋;
2.省人民政府同意設立的公路超限檢(jian)測(ce)站實施(shi)公安(an)派(pai)駐聯合執法(fa);
3.公示的重(zhong)點貨物(wu)裝載源頭巡查(cha)或派駐率100%;
4.公路管理(li)機構全面實施公路超(chao)限(xian)非(fei)現場執法;
5.公路(lu)治超聯合執法處(chu)罰信(xin)息(xi)(xi)100%實施抄告,抄告的(de)本省籍違法超限超載信(xin)息(xi)(xi)100%依法實施“一超四罰”;
6.全面落實(shi)嚴(yan)重違法(fa)失信超限超載當事人(ren)聯合懲戒機(ji)制(zhi);
7.全省(sheng)干線(xian)公路超(chao)限超(chao)載率穩(wen)定控制在3%以內,因超(chao)限超(chao)載引發的(de)道路交通事故率和(he)死亡人數(shu)逐年下降。
三、工作任務(wu)
(一)強化超限檢測站點建設(she)與運(yun)行管理(li)。
1.調整(zheng)完善公(gong)路(lu)超(chao)(chao)(chao)限(xian)檢(jian)測(ce)(ce)站(zhan)(zhan)(zhan)點(dian)布局(ju)(ju)。結合我(wo)省道路(lu)貨(huo)運(yun)(yun)流量流向、路(lu)網結構(gou)、車輛超(chao)(chao)(chao)限(xian)超(chao)(chao)(chao)載(zai)特征(zheng),以及交(jiao)通運(yun)(yun)輸(shu)(shu)執(zhi)法(fa)場所、公(gong)路(lu)管(guan)養節(jie)點(dian)、公(gong)安檢(jian)查(cha)站(zhan)(zhan)(zhan)、交(jiao)警執(zhi)法(fa)服務站(zhan)(zhan)(zhan)設(she)置等(deng)情況,優化超(chao)(chao)(chao)限(xian)檢(jian)測(ce)(ce)站(zhan)(zhan)(zhan)、超(chao)(chao)(chao)限(xian)檢(jian)測(ce)(ce)點(dian)(以下合并簡(jian)稱超(chao)(chao)(chao)限(xian)檢(jian)測(ce)(ce)站(zhan)(zhan)(zhan)點(dian))布局(ju)(ju),實現高速(su)公(gong)路(lu)和普(pu)通國省干線公(gong)路(lu)省際入口、過江通道和主要節(jie)點(dian)全覆蓋。對(dui)違法(fa)超(chao)(chao)(chao)限(xian)超(chao)(chao)(chao)載(zai)運(yun)(yun)輸(shu)(shu)情形嚴(yan)重而(er)未設(she)立超(chao)(chao)(chao)限(xian)檢(jian)測(ce)(ce)站(zhan)(zhan)(zhan)點(dian)的(de)(de)路(lu)段,或者已有超(chao)(chao)(chao)限(xian)檢(jian)測(ce)(ce)站(zhan)(zhan)(zhan)點(dian)不適應超(chao)(chao)(chao)限(xian)超(chao)(chao)(chao)載(zai)治理工作(zuo)需(xu)要的(de)(de),應當調整(zheng)超(chao)(chao)(chao)限(xian)檢(jian)測(ce)(ce)站(zhan)(zhan)(zhan)點(dian)布局(ju)(ju)規劃(hua),及時報省人民政府批準。
2.加強公(gong)路(lu)超(chao)(chao)限(xian)(xian)檢(jian)測(ce)站(zhan)點建(jian)設(she)(she)管理。明確(que)超(chao)(chao)限(xian)(xian)檢(jian)測(ce)站(zhan)點建(jian)設(she)(she)標準、建(jian)設(she)(she)時序和(he)建(jian)設(she)(she)模式,按照(zhao)《江蘇(su)省省級普通國省干線公(gong)路(lu)路(lu)政(zheng)管理專(zhuan)項資金管理辦法》確(que)定建(jian)設(she)(she)經(jing)費來(lai)源,原則上經(jing)省人民(min)政(zheng)府批準設(she)(she)立(li)的超(chao)(chao)限(xian)(xian)檢(jian)測(ce)站(zhan)點在規劃年限(xian)(xian)內完成建(jian)設(she)(she)。新建(jian)、改建(jian)公(gong)路(lu)時,超(chao)(chao)限(xian)(xian)檢(jian)測(ce)站(zhan)點應當與公(gong)路(lu)建(jian)設(she)(she)同步設(she)(she)計、同步施工、同步投入運行。有(you)條件(jian)的超(chao)(chao)限(xian)(xian)檢(jian)測(ce)站(zhan),要為駕(jia)乘人員提供加水、如(ru)廁等便民(min)服務。
3.實(shi)施駐(zhu)站(zhan)(zhan)聯(lian)(lian)(lian)合(he)(he)(he)執法。按照聯(lian)(lian)(lian)合(he)(he)(he)執法實(shi)施意見(jian)明確的(de)超限檢(jian)(jian)測(ce)站(zhan)(zhan)點(dian)(dian)設置要求,結合(he)(he)(he)我省超限超載運輸(shu)特征,確定駐(zhu)站(zhan)(zhan)聯(lian)(lian)(lian)合(he)(he)(he)執法超限檢(jian)(jian)測(ce)站(zhan)(zhan)點(dian)(dian),實(shi)施公(gong)安派駐(zhu)聯(lian)(lian)(lian)合(he)(he)(he)執法。聯(lian)(lian)(lian)合(he)(he)(he)執法的(de)公(gong)安交警執法服務站(zhan)(zhan)、公(gong)安檢(jian)(jian)查站(zhan)(zhan)等,實(shi)行公(gong)路(lu)管理機構執法人員派駐(zhu)。高速公(gong)路(lu)聯(lian)(lian)(lian)合(he)(he)(he)執法站(zhan)(zhan)實(shi)施24小(xiao)時(shi)工(gong)作制,普通公(gong)路(lu)聯(lian)(lian)(lian)合(he)(he)(he)執法站(zhan)(zhan)實(shi)施24小(xiao)時(shi)值守制。
4.明確超限(xian)(xian)檢(jian)測(ce)站(zhan)點執(zhi)(zhi)(zhi)法(fa)(fa)人(ren)(ren)(ren)員(yuan)(yuan)配備標準(zhun)。超限(xian)(xian)檢(jian)測(ce)站(zhan)點路(lu)警聯合(he)(he)治超執(zhi)(zhi)(zhi)法(fa)(fa)人(ren)(ren)(ren)員(yuan)(yuan)必(bi)須相對固定,人(ren)(ren)(ren)員(yuan)(yuan)配置(zhi)必(bi)須滿足(zu)執(zhi)(zhi)(zhi)法(fa)(fa)工(gong)作需(xu)要。一類超限(xian)(xian)檢(jian)測(ce)站(zhan)公(gong)路(lu)聯合(he)(he)執(zhi)(zhi)(zhi)法(fa)(fa)及輔(fu)助(zhu)人(ren)(ren)(ren)員(yuan)(yuan)不低(di)于(yu)15人(ren)(ren)(ren),二類超限(xian)(xian)檢(jian)測(ce)站(zhan)公(gong)路(lu)聯合(he)(he)執(zhi)(zhi)(zhi)法(fa)(fa)及輔(fu)助(zhu)人(ren)(ren)(ren)員(yuan)(yuan)不低(di)于(yu)10人(ren)(ren)(ren),實(shi)施駐站(zhan)聯合(he)(he)執(zhi)(zhi)(zhi)法(fa)(fa)的(de)超限(xian)(xian)檢(jian)測(ce)站(zhan),公(gong)路(lu)執(zhi)(zhi)(zhi)法(fa)(fa)人(ren)(ren)(ren)員(yuan)(yuan)不低(di)于(yu)4人(ren)(ren)(ren),公(gong)安執(zhi)(zhi)(zhi)法(fa)(fa)人(ren)(ren)(ren)員(yuan)(yuan)每班不少于(yu)2人(ren)(ren)(ren)。
5.實(shi)(shi)施超(chao)(chao)(chao)限(xian)(xian)檢(jian)測(ce)(ce)站(zhan)(zhan)(zhan)點(dian)網(wang)(wang)(wang)絡延伸(shen)。公安機關交通管理(li)部門在駐站(zhan)(zhan)(zhan)聯合執法(fa)的超(chao)(chao)(chao)限(xian)(xian)檢(jian)測(ce)(ce)站(zhan)(zhan)(zhan)設(she)立案件處理(li)窗口,實(shi)(shi)施公安網(wang)(wang)(wang)絡延伸(shen),實(shi)(shi)現(xian)違法(fa)超(chao)(chao)(chao)限(xian)(xian)超(chao)(chao)(chao)載案件超(chao)(chao)(chao)限(xian)(xian)檢(jian)測(ce)(ce)站(zhan)(zhan)(zhan)內辦理(li)。公路管理(li)機構(gou)對(dui)超(chao)(chao)(chao)限(xian)(xian)檢(jian)測(ce)(ce)站(zhan)(zhan)(zhan)點(dian)實(shi)(shi)施網(wang)(wang)(wang)絡延伸(shen),實(shi)(shi)現(xian)超(chao)(chao)(chao)限(xian)(xian)超(chao)(chao)(chao)載檢(jian)測(ce)(ce)數據的“部、省、站(zhan)(zhan)(zhan)”三級聯網(wang)(wang)(wang)和超(chao)(chao)(chao)限(xian)(xian)檢(jian)測(ce)(ce)站(zhan)(zhan)(zhan)點(dian)重要節點(dian)視(shi)頻監控。
6.加強(qiang)超(chao)限檢(jian)測(ce)站點運行(xing)管(guan)理(li)。按(an)照(zhao)聯合執(zhi)法(fa)實施意見明(ming)確(que)的稱(cheng)重(zhong)單(dan)登記內容,在(zai)2018年6月底前對超(chao)限檢(jian)測(ce)站點內稱(cheng)重(zhong)設施全面(mian)實施改造,滿(man)足初檢(jian)和復檢(jian)要求(qiu)。超(chao)限檢(jian)測(ce)站點處理(li)大(da)廳重(zhong)點崗位(wei)實行(xing)AB角(jiao)制。超(chao)限檢(jian)測(ce)站點公(gong)(gong)示(shi)公(gong)(gong)路(lu)管(guan)理(li)機構(gou)和公(gong)(gong)安機關(guan)交通管(guan)理(li)部門“執(zhi)法(fa)主體(ti)、執(zhi)法(fa)依(yi)據、執(zhi)法(fa)程(cheng)序、執(zhi)法(fa)監(jian)督、執(zhi)法(fa)結果、當事人(ren)權利”等(deng)相關(guan)信(xin)息,主動接受(shou)社會(hui)監(jian)督。
(二(er))強化路面聯合(he)執法。
7.車貨(huo)總質量(liang)超(chao)(chao)(chao)過《公(gong)(gong)(gong)路貨(huo)運(yun)車輛超(chao)(chao)(chao)限(xian)超(chao)(chao)(chao)載認(ren)定(ding)標準》的(de)違法行(xing)為(wei),統(tong)一(yi)由(you)公(gong)(gong)(gong)安機關交(jiao)通管理(li)部(bu)門實施處罰和記分。對于車貨(huo)總重未超(chao)(chao)(chao)過《公(gong)(gong)(gong)路貨(huo)運(yun)車輛超(chao)(chao)(chao)限(xian)超(chao)(chao)(chao)載認(ren)定(ding)標準》明(ming)確的(de)超(chao)(chao)(chao)限(xian)超(chao)(chao)(chao)載標準但超(chao)(chao)(chao)過公(gong)(gong)(gong)路、隧(sui)道或橋(qiao)梁實際限(xian)載標準的(de)貨(huo)車違法超(chao)(chao)(chao)限(xian)運(yun)輸(shu)行(xing)為(wei),由(you)公(gong)(gong)(gong)路管理(li)機構(gou)依據《公(gong)(gong)(gong)路安全保護(hu)條例(li)》實施處罰。
8.實施駐站(zhan)聯合(he)執(zhi)法(fa)的超(chao)限檢(jian)測站(zhan),由(you)公(gong)安機(ji)(ji)關交通(tong)管(guan)(guan)(guan)(guan)理(li)(li)部門負責(ze)路(lu)面查(cha)處和引導車輛(liang)(liang)進入超(chao)限檢(jian)測站(zhan),公(gong)路(lu)管(guan)(guan)(guan)(guan)理(li)(li)機(ji)(ji)構(gou)負責(ze)檢(jian)測車輛(liang)(liang)裝載情(qing)況并監督消(xiao)除違法(fa)行為,公(gong)安機(ji)(ji)關交通(tong)管(guan)(guan)(guan)(guan)理(li)(li)部門單獨實施處罰和記(ji)分(fen)。公(gong)安機(ji)(ji)關交通(tong)管(guan)(guan)(guan)(guan)理(li)(li)部門、公(gong)路(lu)管(guan)(guan)(guan)(guan)理(li)(li)機(ji)(ji)構(gou)執(zhi)法(fa)時,應當按照《公(gong)安機(ji)(ji)關現場執(zhi)法(fa)視(shi)音頻記(ji)錄(lu)(lu)(lu)工作規(gui)定》、《交警(jing)系統執(zhi)法(fa)記(ji)錄(lu)(lu)(lu)儀使用(yong)管(guan)(guan)(guan)(guan)理(li)(li)規(gui)定》和《江蘇省交通(tong)運輸行政執(zhi)法(fa)視(shi)音頻記(ji)錄(lu)(lu)(lu)管(guan)(guan)(guan)(guan)理(li)(li)辦(ban)法(fa)》的規(gui)定,實施執(zhi)法(fa)全過程視(shi)音頻記(ji)錄(lu)(lu)(lu)。嚴禁違規(gui)收取超(chao)限檢(jian)測費(fei)、停(ting)車保管(guan)(guan)(guan)(guan)費(fei)、通(tong)行費(fei)等費(fei)用(yong)。道(dao)路(lu)運輸管(guan)(guan)(guan)(guan)理(li)(li)機(ji)(ji)構(gou)不單獨上(shang)路(lu)檢(jian)查(cha)貨運車輛(liang)(liang)。
9.開(kai)展駐站聯合(he)執法(fa)時,公安(an)機(ji)關(guan)(guan)交(jiao)通(tong)(tong)管(guan)理(li)部門應當督促違法(fa)超(chao)限超(chao)載(zai)當事人(ren)將(jiang)身份證(zheng)、駕(jia)駛證(zheng)、道路(lu)(lu)運輸經營許可證(zheng)、從業資格證(zheng)、車(che)(che)輛營運證(zheng)、貨(huo)單等(deng)材料交(jiao)公路(lu)(lu)管(guan)理(li)機(ji)構(gou)掃描、拍照(zhao)、復(fu)印留存(cun)。公路(lu)(lu)管(guan)理(li)機(ji)構(gou)應當按照(zhao)聯合(he)執法(fa)實施意見(jian)明(ming)確的稱重和卸載(zai)單所載(zai)明(ming)的信息(xi),結合(he)公安(an)機(ji)關(guan)(guan)交(jiao)通(tong)(tong)管(guan)理(li)部門開(kai)具的行(xing)政處罰決定(ding)書(shu)或道路(lu)(lu)交(jiao)通(tong)(tong)安(an)全(quan)違法(fa)行(xing)為處理(li)通(tong)(tong)知書(shu)等(deng),完整采集、登記違法(fa)超(chao)限超(chao)載(zai)運輸信息(xi),交(jiao)當事人(ren)簽字確認。公路(lu)(lu)管(guan)理(li)機(ji)構(gou)對車(che)(che)輛及貨(huo)物卸駁載(zai)前、后進行(xing)拍照(zhao)留存(cun),并(bing)按照(zhao)“一案一檔”的要求,對采集的上述信息(xi)進行(xing)存(cun)檔。
10.未(wei)實施駐站聯合執法的超(chao)限檢(jian)測(ce)點(dian),由公路管理(li)機構負責路面查處(chu)和引導車輛(liang)進(jin)入超(chao)限檢(jian)測(ce)站點(dian),對車輛(liang)進(jin)行稱(cheng)重(zhong)檢(jian)測(ce)和監督消除違法行為,并通知(zhi)公安(an)機關交通管理(li)部(bu)門,公安(an)機關交通管理(li)部(bu)門應及時到站實施處(chu)罰(fa)和記分。
11.公(gong)路(lu)管(guan)理(li)機構(gou)和(he)公(gong)安機關(guan)交(jiao)通管(guan)理(li)部(bu)門(men)應(ying)(ying)(ying)制定(ding)(ding)流(liu)動(dong)檢(jian)(jian)(jian)(jian)測(ce)(ce)工作方案,實行流(liu)動(dong)檢(jian)(jian)(jian)(jian)測(ce)(ce)計(ji)劃管(guan)理(li),每月排定(ding)(ding)流(liu)動(dong)檢(jian)(jian)(jian)(jian)測(ce)(ce)計(ji)劃,不定(ding)(ding)期聯合開展流(liu)動(dong)檢(jian)(jian)(jian)(jian)測(ce)(ce)。對于故意繞行逃避檢(jian)(jian)(jian)(jian)測(ce)(ce)或者短(duan)途超(chao)(chao)限運(yun)輸情(qing)形嚴(yan)重的地區,要加大聯合流(liu)動(dong)檢(jian)(jian)(jian)(jian)測(ce)(ce)頻次,發現(xian)涉嫌(xian)違法超(chao)(chao)限超(chao)(chao)載車輛,應(ying)(ying)(ying)就近引導(dao)至超(chao)(chao)限檢(jian)(jian)(jian)(jian)測(ce)(ce)站接受檢(jian)(jian)(jian)(jian)查處罰(fa);距離超(chao)(chao)限檢(jian)(jian)(jian)(jian)測(ce)(ce)站較遠的,應(ying)(ying)(ying)當(dang)就近引導(dao)至具有停放車輛和(he)卸載條件的超(chao)(chao)限檢(jian)(jian)(jian)(jian)測(ce)(ce)點接受檢(jian)(jian)(jian)(jian)查處罰(fa)。每月流(liu)動(dong)檢(jian)(jian)(jian)(jian)測(ce)(ce)工作計(ji)劃應(ying)(ying)(ying)分別報送上一級公(gong)路(lu)管(guan)理(li)機構(gou)、公(gong)安機關(guan)交(jiao)通管(guan)理(li)部(bu)門(men)和(he)同級治(zhi)超(chao)(chao)辦。
12.組織(zhi)開展(zhan)(zhan)(zhan)集中(zhong)(zhong)整治行(xing)(xing)(xing)動(dong)(dong)。針對違(wei)法(fa)(fa)超限超載運輸嚴重(zhong)(zhong)的(de)重(zhong)(zhong)點(dian)(dian)地(di)區(qu)和(he)(he)(he)重(zhong)(zhong)點(dian)(dian)路(lu)(lu)段,各執法(fa)(fa)單位(wei)要統籌執法(fa)(fa)力(li)量開展(zhan)(zhan)(zhan)集中(zhong)(zhong)整治行(xing)(xing)(xing)動(dong)(dong)。省(sheng)(sheng)級公路(lu)(lu)管(guan)理機構、公安機關交通管(guan)理部門每(mei)(mei)年聯(lian)合(he)組織(zhi)1-2次(ci)(ci)全省(sheng)(sheng)性的(de)集中(zhong)(zhong)專項整治行(xing)(xing)(xing)動(dong)(dong)。各設區(qu)市每(mei)(mei)年組織(zhi)開展(zhan)(zhan)(zhan)不少(shao)于2次(ci)(ci)的(de)市域范(fan)圍內重(zhong)(zhong)點(dian)(dian)地(di)區(qu)和(he)(he)(he)重(zhong)(zhong)點(dian)(dian)路(lu)(lu)段集中(zhong)(zhong)整治行(xing)(xing)(xing)動(dong)(dong),或(huo)者聯(lian)合(he)相關市組織(zhi)開展(zhan)(zhan)(zhan)針對某一(yi)重(zhong)(zhong)點(dian)(dian)地(di)區(qu)和(he)(he)(he)重(zhong)(zhong)點(dian)(dian)路(lu)(lu)段的(de)集中(zhong)(zhong)整治行(xing)(xing)(xing)動(dong)(dong)。
13.危險化學品運(yun)(yun)(yun)(yun)輸(shu)車輛違法超(chao)限超(chao)載的(de),由(you)公安機關負責路面查處,并依據《危險化學品安全管理條例(li)》第八十八條的(de)有關規定進行(xing)(xing)處罰。運(yun)(yun)(yun)(yun)輸(shu)鮮(xian)活農產品車輛違法超(chao)限超(chao)載運(yun)(yun)(yun)(yun)輸(shu)的(de),通(tong)(tong)行(xing)(xing)收費(fei)公路時(shi),該運(yun)(yun)(yun)(yun)次(ci)不得給(gei)予免收車輛通(tong)(tong)行(xing)(xing)費(fei)的(de)政策優惠(hui);通(tong)(tong)行(xing)(xing)非(fei)收費(fei)公路時(shi),以批評(ping)教育為主(zhu),暫不實施(shi)處罰。
(三)強化高速(su)公路出入口(kou)管控。
14.高速(su)公路(lu)(lu)經(jing)營(ying)管(guan)理單位(wei)應當(dang)制定高速(su)公路(lu)(lu)入(ru)(ru)口安裝稱(cheng)重(zhong)(zhong)檢測(ce)設施實(shi)施方案,有(you)計(ji)劃(hua)地推進實(shi)施入(ru)(ru)口稱(cheng)重(zhong)(zhong)工(gong)作,并實(shi)行檢測(ce)數據和收(shou)費(fei)站(zhan)入(ru)(ru)口發卡(ka)系(xi)統(tong)聯動管(guan)理。2018年在(zai)省際和過江通道收(shou)費(fei)站(zhan)實(shi)施入(ru)(ru)口稱(cheng)重(zhong)(zhong)勸(quan)返(fan),統(tong)一勸(quan)返(fan)標準(zhun)和要求,開展勸(quan)返(fan)工(gong)作。交通流(liu)量大的(de)收(shou)費(fei)站(zhan),高速(su)公路(lu)(lu)經(jing)營(ying)管(guan)理單位(wei)應當(dang)設置專用(yong)勸(quan)返(fan)車(che)道勸(quan)返(fan),其他收(shou)費(fei)站(zhan)可采(cai)取站(zhan)內(nei)調頭勸(quan)返(fan)或者稱(cheng)重(zhong)(zhong)車(che)道倒出(chu)勸(quan)返(fan)等方式。
15.高速公路經營管(guan)理單位應當建立超限超載車(che)輛稱重勸(quan)返現場工作(zuo)方案(an)(an),制(zhi)定車(che)道擁堵疏導方案(an)(an)和應急(ji)預案(an)(an),加強工作(zuo)組織(zhi),配備充(chong)足人員,開展24小時(shi)勸(quan)返工作(zuo)。
16.發現違法(fa)超限(xian)超載車輛時,高速公路(lu)經營(ying)管理單位應當拒絕(jue)其進入高速公路(lu)行駛,并及時報告當地(di)公路(lu)管理機構、公安(an)機關交(jiao)通管理部門,由(you)有關部門按流動聯合(he)執(zhi)法(fa)程(cheng)序進行處理。
17.高速公路(lu)經營管(guan)理(li)單位發現被列(lie)入(ru)我(wo)省高速公路(lu)交(jiao)通(tong)運輸違法(fa)“黑名單”的車(che)輛,應(ying)當及時報告(gao)公路(lu)管(guan)理(li)機構(gou)及時依(yi)法(fa)查處(chu)。對未能及時查處(chu)的嚴重(zhong)超(chao)限(xian)超(chao)載車(che)輛,公路(lu)管(guan)理(li)機構(gou)應(ying)當通(tong)過非現場(chang)執法(fa)方式開展調(diao)查處(chu)理(li)。
18.公路(lu)管理機構應當(dang)將交(jiao)通(tong)(tong)運輸部通(tong)(tong)報(bao)的嚴重(zhong)違(wei)法(fa)失信車(che)輛和被列入我省高(gao)(gao)速(su)公路(lu)交(jiao)通(tong)(tong)運輸違(wei)法(fa)“黑名單(dan)(dan)”的車(che)輛納入高(gao)(gao)速(su)公路(lu)通(tong)(tong)行“黑名單(dan)(dan)”,高(gao)(gao)速(su)公路(lu)經營管理單(dan)(dan)位(wei)應當(dang)拒(ju)絕這類(lei)車(che)輛駛入高(gao)(gao)速(su)公路(lu)。
(四)強化科技應(ying)用和超限非(fei)現場執法。
19.推進基(ji)礎(chu)(chu)信(xin)(xin)息共享。省級交通運(yun)輸(shu)、公安機關實施貨運(yun)車輛(liang)、駕駛人、道路運(yun)輸(shu)企業、重點貨運(yun)場站等基(ji)礎(chu)(chu)信(xin)(xin)息,以及違法(fa)超限(xian)(xian)超載處(chu)(chu)罰信(xin)(xin)息的交換(huan)和(he)共享,提高治超執法(fa)科技化(hua)和(he)信(xin)(xin)息化(hua)水平,實現(xian)車輛(liang)軸型(xing)和(he)裝(zhuang)載標準自動識別、違法(fa)超限(xian)(xian)超載信(xin)(xin)息自動記錄、處(chu)(chu)罰信(xin)(xin)息自動轉遞。
20.完(wan)善(shan)超(chao)限(xian)超(chao)載治理信息(xi)化(hua)監(jian)管網絡(luo)。結合超(chao)限(xian)檢測(ce)(ce)站(zhan)點建設公路運輸車輛(liang)動(dong)態稱(cheng)重檢測(ce)(ce)系統(tong),逐步實現(xian)(xian)對(dui)重要路段、節點貨(huo)運車輛(liang)超(chao)限(xian)超(chao)載信息(xi)自動(dong)檢測(ce)(ce),強化(hua)對(dui)動(dong)態稱(cheng)重檢測(ce)(ce)系統(tong)檢定,滿足非現(xian)(xian)場執(zhi)法(fa)取證(zheng)要求。完(wan)善(shan)檢測(ce)(ce)區域標線、貨(huo)車指(zhi)引標志(zhi)、信息(xi)發(fa)布設備(bei)和抓拍設備(bei),對(dui)貨(huo)運車輛(liang)實施(shi)自動(dong)檢測(ce)(ce),對(dui)貨(huo)運車輛(liang)超(chao)限(xian)超(chao)載的,提示(shi)貨(huo)運車輛(liang)主(zhu)動(dong)進站(zhan)接受檢測(ce)(ce)。貨(huo)運車輛(liang)駕駛人有不(bu)按規(gui)定車道行駛、套牌、遮擋(dang)號(hao)牌、沖(chong)卡(ka)、闖卡(ka)等行為的,由公安機關(guan)依法(fa)處罰。
21.全面(mian)推(tui)進公(gong)路(lu)(lu)超(chao)限(xian)非(fei)現(xian)場(chang)執法(fa)。公(gong)路(lu)(lu)管(guan)理(li)(li)機構(gou)利用動態稱重檢測系統(tong)和計重收費(fei)站檢測數據(ju)對貨運(yun)車(che)輛(liang)實(shi)施(shi)非(fei)現(xian)場(chang)執法(fa),提升違(wei)法(fa)超(chao)限(xian)超(chao)載(zai)(zai)運(yun)輸行(xing)為發現(xian)率、查(cha)(cha)處(chu)率、執行(xing)率。收費(fei)公(gong)路(lu)(lu)經(jing)營管(guan)理(li)(li)單位及(ji)其(qi)收費(fei)站應(ying)當根據(ju)公(gong)路(lu)(lu)管(guan)理(li)(li)機構(gou)調查(cha)(cha)取證的需要,完善計重收費(fei)系統(tong),定期做(zuo)好稱重和視頻監控(kong)等相關設施(shi)設備(bei)的維護(hu)升級,并(bing)協助公(gong)路(lu)(lu)管(guan)理(li)(li)機構(gou)執法(fa)人員開展調查(cha)(cha)取證工作。公(gong)安機關交通管(guan)理(li)(li)部門、道路(lu)(lu)運(yun)輸管(guan)理(li)(li)機構(gou)在年度審驗時發現(xian)存在違(wei)法(fa)超(chao)限(xian)超(chao)載(zai)(zai)行(xing)為未處(chu)理(li)(li)完畢的,應(ying)督促其(qi)接受處(chu)理(li)(li)。
(五)強化貨運(yun)源(yuan)頭聯合執法。
22.各級地方(fang)人民(min)政府組織(zhi)經濟(ji)和信息化部(bu)門(men)(men)、國土(tu)管(guan)理(li)部(bu)門(men)(men)、安監部(bu)門(men)(men)、交通運輸主(zhu)管(guan)部(bu)門(men)(men)等相關部(bu)門(men)(men)對貨物(wu)裝載源(yuan)頭單(dan)位開(kai)展全(quan)面排查,建立貨運源(yuan)頭單(dan)位超(chao)(chao)限超(chao)(chao)載運輸狀況統(tong)計制度,依據貨物(wu)吞吐量、違法超(chao)(chao)限超(chao)(chao)載運輸情(qing)況確定(ding)重(zhong)點(dian)貨運源(yuan)頭單(dan)位,由(you)地方(fang)人民(min)政府每年向(xiang)社會公布。對變動企業(ye)應及(ji)時審核公布。
23.各縣(市(shi)、區)道路(lu)運(yun)(yun)輸管理(li)機構、港(gang)口行政(zheng)管理(li)部門(men)(men)(men)、鄉鎮綜合交通(tong)運(yun)(yun)輸管理(li)所(suo)會同安監部門(men)(men)(men)分(fen)別負(fu)責巡查轄區內的工(gong)礦企業、重點貨運(yun)(yun)站(zhan)場、港(gang)口、碼(ma)頭(tou),巡查次(ci)數每(mei)月不少(shao)于(yu)2次(ci),巡查中(zhong)發現貨物裝(zhuang)載(zai)源頭(tou)單位為貨運(yun)(yun)車輛(liang)超(chao)限超(chao)載(zai)配載(zai)的,由相關部門(men)(men)(men)依法查處。
24.各(ge)地(di)道路運(yun)(yun)輸(shu)管(guan)理機構(gou)要對本(ben)地(di)區人民政府(fu)(fu)公(gong)布的重(zhong)點貨(huo)(huo)運(yun)(yun)源頭單(dan)位引導安裝使(shi)用稱(cheng)(cheng)重(zhong)設(she)備和(he)視頻監控(kong)設(she)備。2018年底(di)之前,各(ge)設(she)區的市交(jiao)通運(yun)(yun)輸(shu)主管(guan)部門要提請(qing)地(di)方人民政府(fu)(fu)試點確定(ding)1批重(zhong)點貨(huo)(huo)運(yun)(yun)源頭單(dan)位安裝使(shi)用稱(cheng)(cheng)重(zhong)設(she)備和(he)視頻監控(kong)設(she)備,對貨(huo)(huo)物裝載情況實時(shi)監管(guan)。
25.各(ge)設區(qu)的市、各(ge)縣(市、區(qu))交(jiao)通運輸(shu)主(zhu)管部門、公安機關會同安監部門對轄(xia)區(qu)內(nei)超(chao)限超(chao)載情(qing)節(jie)較嚴(yan)重(zhong)的重(zhong)點貨運源頭單位進行約談,督促貨運源頭企業落實安全(quan)生產(chan)主(zhu)體責任,從源頭遏止違(wei)法超(chao)限超(chao)載運輸(shu)。
(六)強化“一超(chao)四罰”和(he)失(shi)信聯合懲戒(jie)。
26.縣(市、區(qu))級公(gong)(gong)路(lu)管理機構、高(gao)速公(gong)(gong)路(lu)交通運輸執法大(da)隊(dui)整理匯總本(ben)地區(qu)違法超(chao)(chao)限超(chao)(chao)載“一案一檔”資料,每月逐級上報至省(sheng)級公(gong)(gong)路(lu)管理機構。省(sheng)級交通運輸、公(gong)(gong)安(an)機關完善(shan)公(gong)(gong)路(lu)超(chao)(chao)限管理系統(tong)、運政在線(xian)系統(tong)和公(gong)(gong)安(an)交警業務管理系統(tong)功能(neng),實現信(xin)息的自動(dong)采集、統(tong)計、抄告、接收和反饋。
27.省(sheng)級(ji)公(gong)(gong)路(lu)管(guan)(guan)理(li)(li)機(ji)(ji)構(gou)匯總本省(sheng)違法超(chao)(chao)限超(chao)(chao)載車輛的檢測信(xin)(xin)息和(he)公(gong)(gong)安機(ji)(ji)關交通管(guan)(guan)理(li)(li)部門的處罰(fa)信(xin)(xin)息,抄送車籍、從(cong)業(ye)資格(ge)證(zheng)、道(dao)路(lu)運(yun)輸(shu)(shu)經營許可證(zheng)、貨物裝(zhuang)載地所(suo)在地省(sheng)級(ji)道(dao)路(lu)運(yun)輸(shu)(shu)管(guan)(guan)理(li)(li)機(ji)(ji)構(gou)。公(gong)(gong)路(lu)管(guan)(guan)理(li)(li)機(ji)(ji)構(gou)單(dan)獨(du)實施處罰(fa)的違法超(chao)(chao)限運(yun)輸(shu)(shu)行為(wei),由省(sheng)級(ji)公(gong)(gong)路(lu)管(guan)(guan)理(li)(li)機(ji)(ji)構(gou)匯總抄告。
28.省級交通運(yun)輸(shu)、公安機(ji)關聯合制定“江蘇省貨車(che)(che)超(chao)限(xian)超(chao)載(zai)源頭處罰實施細則”,由道(dao)(dao)路運(yun)輸(shu)管理機(ji)構(gou)依法(fa)對本省違法(fa)超(chao)限(xian)超(chao)載(zai)貨運(yun)車(che)(che)輛(liang)、貨運(yun)車(che)(che)輛(liang)駕(jia)駛人、道(dao)(dao)路運(yun)輸(shu)企業和貨運(yun)場(chang)所經營者進行相(xiang)應處罰。
29.實施失信(xin)聯(lian)(lian)合懲戒(jie)。按照《江蘇省(sheng)交(jiao)(jiao)(jiao)(jiao)通(tong)運輸系統對嚴重(zhong)違(wei)(wei)法(fa)失信(xin)超限超載運輸行為相關責任(ren)(ren)主(zhu)體實施聯(lian)(lian)合懲戒(jie)工作方案(an)》明確的責任(ren)(ren)分工,做好十項嚴重(zhong)違(wei)(wei)法(fa)失信(xin)超限超載運輸行為和相關責任(ren)(ren)主(zhu)體信(xin)息匯(hui)總(zong)和報(bao)送工作,由縣級(ji)(ji)公(gong)路(lu)管(guan)(guan)理(li)(li)機(ji)(ji)構逐級(ji)(ji)匯(hui)總(zong)上報(bao)至省(sheng)級(ji)(ji)公(gong)路(lu)管(guan)(guan)理(li)(li)機(ji)(ji)構,涉(she)及公(gong)安機(ji)(ji)關交(jiao)(jiao)(jiao)(jiao)通(tong)管(guan)(guan)理(li)(li)部(bu)門(men)處罰的失信(xin)信(xin)息,公(gong)安機(ji)(ji)關交(jiao)(jiao)(jiao)(jiao)通(tong)管(guan)(guan)理(li)(li)部(bu)門(men)應及時提交(jiao)(jiao)(jiao)(jiao)同(tong)級(ji)(ji)公(gong)路(lu)管(guan)(guan)理(li)(li)機(ji)(ji)構。省(sheng)級(ji)(ji)公(gong)路(lu)管(guan)(guan)理(li)(li)機(ji)(ji)構匯(hui)總(zong)后,依照有關規定,上報(bao)交(jiao)(jiao)(jiao)(jiao)通(tong)運輸部(bu),由交(jiao)(jiao)(jiao)(jiao)通(tong)運輸部(bu)在“信(xin)用交(jiao)(jiao)(jiao)(jiao)通(tong)”網站(zhan)公(gong)布(bu)。
(七)強化執(zhi)法協作(zuo)和聯動機制。
30.各級交通運輸主管部門、公安機關建立(li)定期會(hui)商和通報制度,按(an)季度召開聯(lian)合執(zhi)法工(gong)作例會(hui),通報工(gong)作開展情(qing)況,部署下階段工(gong)作,并對歷次會(hui)議(yi)和通報情(qing)況進(jin)行記(ji)錄、存檔、備查。遇(yu)到重大(da)問(wen)題需協調解(jie)決的(de),應(ying)專(zhuan)題召開會(hui)議(yi)進(jin)行研究(jiu),推進(jin)聯(lian)合執(zhi)法工(gong)作的(de)開展。
31.公(gong)(gong)(gong)(gong)路(lu)(lu)管理(li)機(ji)構、公(gong)(gong)(gong)(gong)安(an)機(ji)關(guan)交通(tong)管理(li)部(bu)門建立高速(su)公(gong)(gong)(gong)(gong)路(lu)(lu)和(he)普(pu)通(tong)公(gong)(gong)(gong)(gong)路(lu)(lu)聯動執(zhi)法工(gong)作機(ji)制(zhi)。依(yi)托(tuo)高速(su)公(gong)(gong)(gong)(gong)路(lu)(lu)出(chu)入口和(he)高速(su)公(gong)(gong)(gong)(gong)路(lu)(lu)周(zhou)邊公(gong)(gong)(gong)(gong)路(lu)(lu)超限檢測站點(dian),定期(qi)不定期(qi)開展(zhan)高速(su)公(gong)(gong)(gong)(gong)路(lu)(lu)和(he)普(pu)通(tong)公(gong)(gong)(gong)(gong)路(lu)(lu)治(zhi)理(li)超限超載工(gong)作聯合(he)執(zhi)法,保持執(zhi)法力度的協調(diao)統一。
32.全面建(jian)立(li)(li)省(sheng)際(ji)(ji)交(jiao)界(jie)地區、路(lu)段跨(kua)省(sheng)聯(lian)合(he)執(zhi)法工作(zuo)機制(zhi)。完善蘇(su)(su)浙、蘇(su)(su)魯皖聯(lian)合(he)執(zhi)法工作(zuo)機制(zhi),推動建(jian)立(li)(li)蘇(su)(su)滬、蘇(su)(su)皖、蘇(su)(su)魯省(sheng)際(ji)(ji)聯(lian)合(he)執(zhi)法工作(zuo)機制(zhi),協同兄弟省(sheng)份開展省(sheng)際(ji)(ji)交(jiao)界(jie)治超聯(lian)合(he)執(zhi)法。與外省(sheng)臨(lin)近的(de)地區,每年開展跨(kua)省(sheng)聯(lian)合(he)執(zhi)法次數不少于1次。
(八)強化責任(ren)落實。
33.嚴格落實地(di)方人(ren)民(min)政(zheng)(zheng)府(fu)(fu)超(chao)限(xian)超(chao)載治(zhi)理工作(zuo)(zuo)主(zhu)體責任。將超(chao)限(xian)超(chao)載治(zhi)理工作(zuo)(zuo)納入(ru)各級地(di)方人(ren)民(min)政(zheng)(zheng)府(fu)(fu)和交通運輸主(zhu)管部門、公(gong)安機(ji)關年度工作(zuo)(zuo)任務實施考(kao)核。依托省治(zhi)超(chao)辦平臺,定期(qi)通報超(chao)限(xian)超(chao)載治(zhi)理工作(zuo)(zuo)成效(xiao)、存在(zai)問題等,壓實地(di)方人(ren)民(min)政(zheng)(zheng)府(fu)(fu)和成員單位治(zhi)超(chao)工作(zuo)(zuo)責任。
34.各地(di)交通(tong)運(yun)輸主管部(bu)(bu)門、公安(an)(an)機(ji)關應主動(dong)履職,嚴(yan)格(ge)執(zhi)法(fa)。按照(zhao)統一(yi)(yi)(yi)的認定標準(zhun)和處罰標準(zhun),公安(an)(an)機(ji)關交通(tong)管理(li)部(bu)(bu)門對(dui)違法(fa)超(chao)(chao)限(xian)(xian)超(chao)(chao)載(zai)行(xing)為(wei)(wei)嚴(yan)格(ge)實施(shi)記(ji)分制度,道路(lu)運(yun)輸管理(li)機(ji)構對(dui)道路(lu)運(yun)輸經營(ying)者、從(cong)業人員實施(shi)信用管理(li)。對(dui)滿足《公路(lu)安(an)(an)全保護條例(li)》第六十六條、《道路(lu)運(yun)輸條例(li)》第七(qi)十一(yi)(yi)(yi)條規定的違法(fa)超(chao)(chao)限(xian)(xian)超(chao)(chao)載(zai)行(xing)為(wei)(wei),嚴(yan)格(ge)實施(shi)“一(yi)(yi)(yi)超(chao)(chao)四罰”,堅(jian)決(jue)查處違法(fa)超(chao)(chao)限(xian)(xian)超(chao)(chao)載(zai)行(xing)為(wei)(wei)。對(dui)于尋釁滋事(shi)、堵塞車道等違法(fa)行(xing)為(wei)(wei),公安(an)(an)機(ji)關應依法(fa)查處。
35.收費公路(lu)(lu)經營管理(li)單位切實履(lv)行(xing)收費站現場管理(li)主(zhu)體責任(ren),拒絕違(wei)(wei)法(fa)超(chao)(chao)限超(chao)(chao)載(zai)車輛行(xing)駛收費道(dao)(dao)路(lu)(lu)。貨(huo)運車輛所有人(ren)、道(dao)(dao)路(lu)(lu)運輸從業者、道(dao)(dao)路(lu)(lu)運輸企業和貨(huo)物裝載(zai)源頭(tou)單位要嚴(yan)格落實合法(fa)裝載(zai)義(yi)務(wu),自覺(jue)抵制違(wei)(wei)法(fa)配載(zai)和超(chao)(chao)限超(chao)(chao)載(zai)上路(lu)(lu)行(xing)駛行(xing)為。
(九(jiu))強化執法(fa)監(jian)督(du)。
36.明(ming)確全省服(fu)務監督電話(hua)統一為12328、12389,受(shou)理(li)(li)投(tou)訴(su)舉報,強化行政復(fu)議(yi)、申(shen)(shen)訴(su)渠道(dao),依(yi)法(fa)受(shou)理(li)(li)、及(ji)時處(chu)理(li)(li)復(fu)議(yi)申(shen)(shen)請和(he)申(shen)(shen)訴(su),及(ji)時查處(chu)和(he)糾正違規執法(fa)行為,每季度對所(suo)在區域(yu)執法(fa)處(chu)罰情(qing)況進(jin)行網(wang)上公(gong)示公(gong)開(kai),最大限(xian)度保護行政相對人的合(he)法(fa)權益(yi)。
37.加大(da)對(dui)重(zhong)點地區的(de)督導(dao)。按照本方案制定(ding)督查計劃,對(dui)各地超(chao)限超(chao)載治理工作開展督導(dao)檢查,對(dui)工作不力、問題突出的(de),將按照有(you)關規定(ding)嚴肅處理,并在全省范圍內通報。
38.承擔(dan)超(chao)(chao)(chao)限超(chao)(chao)(chao)載(zai)(zai)治理職責的部(bu)門(men)和單(dan)位,對查獲的違法超(chao)(chao)(chao)限超(chao)(chao)(chao)載(zai)(zai)車(che)輛,應當倒查其所(suo)屬單(dan)位或(huo)者自(zi)然人(ren)、裝載(zai)(zai)貨物源(yuan)頭(tou)或(huo)者非法改裝車(che)輛的場(chang)所(suo)等涉及單(dan)位的過錯(cuo)責任,相(xiang)關部(bu)門(men)未(wei)按規定履行車(che)輛超(chao)(chao)(chao)限超(chao)(chao)(chao)載(zai)(zai)治理管理或(huo)監管職責的,追究該部(bu)門(men)有關人(ren)員責任。
四(si)、工作要求
(一(yi))加強(qiang)組織領導。各地(di)人民政府要(yao)(yao)切(qie)(qie)實(shi)加強(qiang)治(zhi)(zhi)理車輛超(chao)(chao)限(xian)超(chao)(chao)載聯合(he)執法(fa)常態化制(zhi)度(du)化工(gong)(gong)(gong)(gong)作的(de)組織領導,實(shi)施公(gong)路(lu)(lu)治(zhi)(zhi)超(chao)(chao)工(gong)(gong)(gong)(gong)作目標考核(he),對公(gong)路(lu)(lu)治(zhi)(zhi)超(chao)(chao)工(gong)(gong)(gong)(gong)作取得成(cheng)效的(de),予以表彰(zhang)。對公(gong)路(lu)(lu)治(zhi)(zhi)超(chao)(chao)工(gong)(gong)(gong)(gong)作不力的(de),予以通報(bao)批(pi)評并(bing)責令(ling)整改。各地(di)要(yao)(yao)制(zhi)定適合(he)本地(di)區超(chao)(chao)限(xian)超(chao)(chao)載治(zhi)(zhi)理工(gong)(gong)(gong)(gong)作實(shi)施方案,進一(yi)步明確職(zhi)(zhi)責任務(wu)。各級交通運輸主管部(bu)門和公(gong)安機關(guan)要(yao)(yao)充分認(ren)識公(gong)路(lu)(lu)治(zhi)(zhi)超(chao)(chao)聯合(he)執法(fa)常態化制(zhi)度(du)化工(gong)(gong)(gong)(gong)作的(de)重要(yao)(yao)性,將超(chao)(chao)限(xian)超(chao)(chao)載治(zhi)(zhi)理工(gong)(gong)(gong)(gong)作聯合(he)執法(fa)常態化制(zhi)度(du)化工(gong)(gong)(gong)(gong)作與其它重點工(gong)(gong)(gong)(gong)作同(tong)部(bu)署同(tong)落實(shi)同(tong)考核(he),切(qie)(qie)實(shi)推進依法(fa)規范履行法(fa)定職(zhi)(zhi)責。
(二)強化執(zhi)(zhi)法保(bao)(bao)障(zhang)。各地(di)人民政府(fu)要進一(yi)步規范公路超(chao)限(xian)檢(jian)(jian)(jian)測(ce)(ce)站(zhan)(zhan)人員(yuan)配置(zhi)標準,合理配置(zhi)超(chao)限(xian)檢(jian)(jian)(jian)測(ce)(ce)站(zhan)(zhan)執(zhi)(zhi)法人員(yuan),將超(chao)限(xian)檢(jian)(jian)(jian)測(ce)(ce)站(zhan)(zhan)點(dian)(dian)人員(yuan)基本(ben)支(zhi)出納入(ru)同級(ji)財政預算(suan)予以保(bao)(bao)障(zhang),嚴禁將罰沒收(shou)入(ru)同部門經(jing)費(fei)保(bao)(bao)障(zhang)掛鉤。省級(ji)交通運輸、公安機關要加大超(chao)限(xian)檢(jian)(jian)(jian)測(ce)(ce)站(zhan)(zhan)點(dian)(dian)建(jian)設及運行(xing)經(jing)費(fei)、信息化建(jian)設經(jing)費(fei)、執(zhi)(zhi)法裝備配置(zhi)等專項經(jing)費(fei)的投入(ru)。各設區市(shi)交通運輸主管部門每年將轄區內公路超(chao)限(xian)檢(jian)(jian)(jian)測(ce)(ce)站(zhan)(zhan)基本(ben)支(zhi)出保(bao)(bao)障(zhang)情況上(shang)報省交通運輸廳。
(三)營造(zao)良(liang)好氛圍(wei)。各(ge)地各(ge)部門要對治理車輛超限(xian)超載聯(lian)(lian)合執(zhi)(zhi)(zhi)法(fa)(fa)常態化制度(du)化工(gong)作(zuo)開展(zhan)正面(mian)宣傳和報道,創造(zao)良(liang)好的執(zhi)(zhi)(zhi)法(fa)(fa)環境。充分(fen)利用多種新聞媒體,大力宣傳治理車輛超限(xian)超載的重要意義和成效(xiao),及(ji)時公布聯(lian)(lian)合執(zhi)(zhi)(zhi)法(fa)(fa)業務流(liu)程、行政處(chu)罰(fa)和檢(jian)查清單等重點內容,鼓勵(li)社會公眾加強(qiang)對治超執(zhi)(zhi)(zhi)法(fa)(fa)工(gong)作(zuo)的監督(du),促進聯(lian)(lian)合執(zhi)(zhi)(zhi)法(fa)(fa)工(gong)作(zuo)有效(xiao)開展(zhan)。
(四)嚴格文明執法(fa)(fa)(fa)(fa)。嚴格遵守聯合執法(fa)(fa)(fa)(fa)實施意見明確(que)的“十不(bu)準(zhun)”紀律。加(jia)大明察暗訪(fang)檢查頻率,嚴肅處理不(bu)規范執法(fa)(fa)(fa)(fa)行(xing)為,有效防止公路“三亂(luan)”行(xing)為的發生。對媒(mei)體曝光和群眾(zhong)投(tou)訴、舉報的違(wei)法(fa)(fa)(fa)(fa)違(wei)規執法(fa)(fa)(fa)(fa)問題,要及時(shi)進行(xing)調查,嚴肅處理,構(gou)成犯罪的,依法(fa)(fa)(fa)(fa)追(zhui)究(jiu)刑事責任。
(五)加(jia)強(qiang)信息(xi)報(bao)送。各(ge)地(di)(di)區、各(ge)相關(guan)(guan)部(bu)門(men)要(yao)明(ming)確(que)專人負責(ze)信息(xi)報(bao)送工(gong)(gong)(gong)作(zuo)(zuo),暢(chang)通(tong)信息(xi)報(bao)送渠(qu)道,密(mi)切關(guan)(guan)注(zhu)本地(di)(di)區超(chao)限(xian)超(chao)載治理(li)聯(lian)合執(zhi)法工(gong)(gong)(gong)作(zuo)(zuo)進展情況,出現重(zhong)大情況的,要(yao)及時(shi)向政府(fu)報(bao)告(gao),并抄報(bao)上一(yi)級(ji)行業主管(guan)部(bu)門(men)。各(ge)設區市(shi)交通(tong)運輸主管(guan)部(bu)門(men)按照附(fu)件(jian)要(yao)求,匯(hui)總本地(di)(di)超(chao)限(xian)超(chao)載治理(li)工(gong)(gong)(gong)作(zuo)(zuo)情況,并在每月5日前上報(bao)省(sheng)交通(tong)運輸廳(ting),涉及公安機關(guan)(guan)交通(tong)管(guan)理(li)部(bu)門(men)的超(chao)限(xian)超(chao)載治理(li)工(gong)(gong)(gong)作(zuo)(zuo)情況,公安機關(guan)(guan)交通(tong)管(guan)理(li)部(bu)門(men)應及時(shi)提交同(tong)級(ji)公路管(guan)理(li)機構。
